{"id":14542,"date":"2014-05-11T06:59:47","date_gmt":"2014-05-11T13:59:47","guid":{"rendered":"http:\/\/amicuscuria.com\/wordpress\/?p=14542"},"modified":"2014-05-11T07:00:12","modified_gmt":"2014-05-11T14:00:12","slug":"ny-cops-beat-black-man-for-recording-traffic-stop","status":"publish","type":"post","link":"http:\/\/amicuscuria.com\/wordpress\/ny-cops-beat-black-man-for-recording-traffic-stop\/","title":{"rendered":"NY Cops Beat Black Man for Recording Traffic Stop"},"content":{"rendered":"<div style=\"width: 596px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/photographyisnotacrime.com\/wp-content\/uploads\/2014\/05\/Kyle-Howell-300x223.jpg\" alt=\"Kyle Howell\" width=\"586\" height=\"436\" \/><p class=\"wp-caption-text\">Kyle Howell<\/p><\/div>\n<p><em>by Carlos Miller of PINAC<\/em><\/p>\n<p><strong>Nassau County, NY (5-8-14) &#8212;<\/strong>\u00a0Last January, Kyle Howell was pulled over by Nassau County police in New York and pulled out his phone to record the stop, only to get threatened with violence if he dared do it again.<\/p>\n<p style=\"color: #333333;\">Last month, he was pulled over again by the same officer, boldly pulling out his phone to record the stop despite the previous threat \u2013 only for the cop and another cop to make good on the threat by viciously beating him in a violent rage.<span id=\"more-30916\"><\/span><\/p>\n<p style=\"color: #333333;\">The cops prevented him from recording the arrest, enabling them to conjure a story that they were the ones attacked in a \u201cviolent struggle\u201d that sent them to the hospital for treatment, justifying felony charges against the 20-year-old man who had only been pulled over for a cracked windshield.<\/p>\n<p style=\"color: #333333;\">But then a surveillance video emerged showing that the cops were the aggressors. And now his family is planning on suing.<\/p>\n<p style=\"color: #333333;\">According to\u00a0<a style=\"color: #551a8b;\" href=\"http:\/\/www.newsday.com\/long-island\/nassau\/lawyers-for-westbury-man-say-video-captured-nassau-police-beating-1.7930542\" target=\"_blank\">Newsday:<\/a><\/p>\n<blockquote style=\"color: #333333;\">\n<p style=\"font-weight: 300; color: #4a4a4a;\">A lawyer for Howell filed a legal claim against the county Monday seeking unspecified damages.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">Howell said he didn\u2019t put up a fight but suffered a broken nose, bone fractures near both eyes and facial nerve damage.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">After Howell\u2019s release on $10,000 bond following a hospital arraignment, he and his father got a video from a store security camera that captured his police encounter, according to his family. Howell said he also started recording on his cellphone before the officers came up to his car. He said police began beating him after one officer took away his phone. Howell said the same officer had warned him during a January traffic stop not to record him again.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">\u201cHe said \u2018The next time you record me I will use physical force to stop you,\u2019 \u201d Howell said.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">He recalled getting a knee to his face, being hit repeatedly in the head and hearing police telling him to spit something out.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">He said he was only chewing gum, didn\u2019t have any drugs, and didn\u2019t hit the police back.<\/p>\n<p style=\"font-weight: 300; color: #4a4a4a;\">Attorney Amy Marion filed the notice of claim with the county Monday claiming Howell was the victim of false arrest, excessive police force, and deprived of his civil rights, including by Nassau University Medical Center employees who concealed illegal police behavior.<\/p>\n<\/blockquote>\n<p style=\"color: #333333;\">Howell, who may be left with permanent vision problems, was charged with assaulting the cops, tampering with physical evidence and resisting arrest.<\/p>\n<p style=\"color: #333333;\">As ironic as it is, the tampering with evidence charge stems from the allegation that Howell had been trying to eat marijuana police had found in his car.<\/p>\n<p style=\"color: #333333;\">He insists he was only chewing gum.<\/p>\n<p style=\"color: #333333;\">This is what he told\u00a0<a style=\"color: #551a8b;\" href=\"http:\/\/newyork.cbslocal.com\/2014\/05\/06\/li-man-suing-nassau-county-police-over-beating-da-looking-into-incident\/\" target=\"_blank\">CBS:<\/a><\/p>\n<blockquote style=\"color: #333333;\">\n<p style=\"font-weight: 300; color: #666666;\">\u201cI remember getting a knee to my face and after that, I don\u2019t really remember much. I was hit in the head so many times,\u201d Howell said. \u201cThey were telling me to spit something out of my mouth.\u201d<\/p>\n<p style=\"font-weight: 300; color: #666666;\">\u201cThey came out of the car, I gave them my information, they opened up the door and my paycheck started to fly out the door. I went to go reach and the next thing you know, I got a knee to the face.
