The petition was badly written (intent is a core requirement) in its allegations, opined Judge Pomeroy. \u00a0Mr. Hupp had a very accomplished attorney, Mr. Meyers. \u00a0And I found myself guessing beforehand the decision would be confounding.<\/p>\n<p>Having filmed the proceedings, I&#8217;ll post the video and stills I took as soon as I finish editing them. \u00a0The main courtroom where the hearing took place was packed with advocates from both sides of the issue and Mr. Hupp. \u00a0The attorneys and the Judge admitted they knew little or nothing of the merits beyond the allegations in the petition itself. \u00a0But the ruling in Mr. Hupp&#8217;s favor doesn&#8217;t preclude future better written recall petitions.<\/p>\n<p>The Judge refused to find cause to enter Rule 11 sanctions against the Petitioners. \u00a0Rule 11 is reserved for those who file frivolous or specious lawsuits&#8230;basically SLAPP (intended to annoy or harass) lawsuits. \u00a0Judge Pomeroy found the lawsuit was filed in good faith. \u00a0She didn&#8217;t keep the courtroom crowd waiting&#8230;she ruled immediately after both sides had completed presenting their case.<\/p>\n<div id=\"attachment_743\" style=\"width: 650px\" class=\"wp-caption alignleft\"><a href=\"http:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2010\/11\/P1000591.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-743\" class=\"size-large wp-image-743\" title=\"Leonard G. Thompson) while pursuing this issue. \u00a0I was confronted by Leonard G.
