{"id":14554,"date":"2014-05-11T07:28:03","date_gmt":"2014-05-11T14:28:03","guid":{"rendered":"http:\/\/amicuscuria.com\/wordpress\/?p=14554"},"modified":"2014-05-11T07:28:03","modified_gmt":"2014-05-11T14:28:03","slug":"incompetent-chicago-security-guard-deletes-photos","status":"publish","type":"post","link":"https:\/\/amicuscuria.com\/wordpress\/incompetent-chicago-security-guard-deletes-photos\/","title":{"rendered":"Incompetent Chicago Security Guard Deletes Photos"},"content":{"rendered":"<p><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/zok3oCfm8Bk\" width=\"640\" height=\"360\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><em>by Andrew Meyer of PINAC<\/em><\/p>\n<p><strong>Chicago, IL (5-6-14) &#8212;<\/strong>\u00a0\u201cI\u2019m gonna erase the memory card.\u201d<\/p>\n<p style=\"color: #333333;\">A security guard for Acme Refining in Chicago followed through on this threat, and deleted two days\u2019 worth of Benn Jordan\u2019s photography.<\/p>\n<p style=\"color: #333333;\">Jordan was taking landscape photos from a public area of the South Side of Chicago when security guards rolled up on him and started getting physical.<span id=\"more-30881\"><\/span><\/p>\n<p style=\"color: #333333;\">In the video Jordan posted to YouTube called, \u201cThis crap is why I can\u2019t make a timelapse landscape of Chicago,\u201d you can see part of Jordan\u2019s encounter, as Acme\u2019s overly aggressive security guard pushes the camera phone Jordan used to film the altercation.<\/p>\n<p style=\"color: #333333;\">The security guard seizes Jordan\u2019s camera, claiming he was on private property while threatening to call the cops, insinuating Jordan had criminal intentions. Similar to the staff at an\u00a0<a style=\"color: #551a8b;\" href=\"http:\/\/photographyisnotacrime.com\/2014\/05\/02\/photographing-models-declared-suspicious-activity-illinois-refinery-police-follow-suit\/\">Illinois refinery who recently<\/a>\u00a0tried to have a photographer arrested, this security guard seems to be treating photography as a form of terrorism.<\/p>\n<p style=\"color: #333333;\">Jordan said the aggression took place before he was able to turn on his camera phone.<\/p>\n<p style=\"color: #333333;\">\u201cI wish I could get to my phone sooner when they initially approached me, as I definitely have grounds for assault,\u201d Jordan said.<\/p>\n<p style=\"color: #333333;\">In the YouTube video description, Jordan says Acme has resolved the situation, and is meeting with them to get his damaged equipment replaced.<\/p>\n<p style=\"color: #333333;\">If Jordan decides to file a lawsuit for assault, battery, and destruction of property \u2013 as he legally could \u2013 Acme will learn, as all businesses should, to be careful when hiring security guards because a lawsuit can end up costing more than a security guard would ever save.<\/p>\n<p style=\"color: #333333;\">Legally, security guards do not have the right to delete photographs. And they can only ask trespassers \u2013 which Jordan wasn\u2019t as he was standing on the sidewalk \u2013 to leave the property or have them arrested. Even a police officer cannot legally delete a person\u2019s photos as spelled out by the U.S. Dept. of Justice in this\u00a0<a style=\"color: #551a8b;\" href=\"http:\/\/static.photographyisnotacrime.com\/wp-content\/uploads\/2013\/02\/USDOJ-on-recording-cops.pdf\">document<\/a>.<\/p>\n<p style=\"color: #333333;\">A final note on this story \u2013 Benn Jordan also happens to be an accomplished\u00a0<a style=\"color: #551a8b;\" href=\"http:\/\/en.wikipedia.org\/wiki\/Benn_Jordan\">musician<\/a>.
