Guess what they did:<\/strong> <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A. Realized their process for labeling people child abusers was rife with error and fixed it.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>B.&nbsp;<\/strong><strong>Invented a way to evade the hearings.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(After a court saw through DCF\u2019s ploy, the agency started providing the hearings).<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every state has some version of a \u201ccentral register\u201d of people accused of child abuse or neglect.&nbsp; The process and the consequences&nbsp;<a href=\"https:\/\/academicworks.cuny.edu\/cgi\/viewcontent.cgi?article=1510&amp;context=clr\">vary from state to state<\/a>, but they have one thing in common: It is extremely easy to be put on these registers and extremely difficult to get off again.&nbsp; They amount to state databases of rumor and innuendo.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In almost every state, getting on the register requires only that a caseworker check a box on a form stating it is slightly more likely than not that you are a child abuser \u2013 or simply slightly more likely than not that you are guilty of \u201cneglect,\u201d a label that can be slapped on&nbsp;<a href=\"https:\/\/nccpr.org\/issue-papers-family-preservation-foster-care-and-reasonable-efforts\/nccpr-issue-paper-5-who-is-in-the-system-and-why\/\">almost anyone who is poor,<\/a>&nbsp;if a caseworker is so inclined.&nbsp;&nbsp;In some states, including Massachusetts, the standard is even lower.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes a supervisor has to check the box, too.\u00a0\u00a0That\u2019s it.\u00a0\u00a0There\u2019s no independent factfinding beforehand, no chance to present a defense, no neutral arbiter evaluating all sides. The caseworker\u2019s word is law.\u00a0\u00a0Once on the register, you have to fight your way out.\u00a0\u00a0The process varies from state to state, but again, there\u2019s one thing in common: If you can\u2019t afford a lawyer you\u2019re unlikely to get one.\u00a0\u00a0It\u2019s you, on your own, vs. the entire family police bureaucracy.\u00a0\u00a0And since overwhelmingly the people labeled \u201cchild abusers\u201d are poor, well \u2026\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All this&nbsp;<a href=\"https:\/\/www.buzzfeednews.com\/article\/scottpham\/child-abuse-and-neglect-registries-punish-parents-of-color\">does enormous harm to children<\/a>.&nbsp;&nbsp;A listing on a central register can be a barrier to a huge number of jobs \u2013 often the very jobs most likely to be open to poor people. So the listing drives them further into poverty, harming their children and, of course, making it more likely that the poverty will be confused with neglect.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the listing increases the odds that, even if the children weren\u2019t thrown into foster care this time, it will happen if the family is reported again \u2013 because the listing raises suspicions, whether it\u2019s the guess of a human caseworker or&nbsp;<a href=\"https:\/\/bigdataiswatching.blogspot.com\/\">a computer algorithm<\/a>&nbsp;raising a family\u2019s \u201crisk score.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In spite of the way the deck is stacked, a stunning number of people who fight these determinations win.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So in Massachusetts, where you can seek an administrative hearing to fight your way out, even though the burden of proof is on you to show you are innocent, families win about half the time.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One might hope that a record like that might give a family police agency second thoughts; that they might think: Hey, wait a minute, if as soon as a neutral arbiter looks at this, despite the way we\u2019ve stacked the deck, the arbiters say we\u2019re wrong half the time maybe that means&nbsp;<em>we\u2019re wrong half the time&nbsp;<\/em>and we need to fix this.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As far as I know, that\u2019s never happened.&nbsp;&nbsp;Not in Massachusetts and not in other states where the rate at which these findings are overturned on appeal can be even higher.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But only Massachusetts DCF came up with this oh-so-clever little workaround: make up an entire new category out of whole cloth, make it slightly less harmful than the really bad category&nbsp;&nbsp;and unilaterally deny families fair hearings!&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until 2015, DCF had two boxes a worker could check: \u201csupported\u201d and \u201cunsupported.\u201d\u00a0\u00a0An unsupported finding did not lead to a listing in the central register and other adverse consequences, a supported finding did.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"594\" src=\"http:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Justice-Innocence.jpeg\" alt=\"Justice Defending Innocence\" class=\"wp-image-29157\" srcset=\"https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Justice-Innocence.jpeg 700w, https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Justice-Innocence-300x255.jpeg 300w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><figcaption class=\"wp-element-caption\">Justice Defending Innocence<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">But then, faced with all those supported findings being overturned on appeal, DCF suddenly decreed<br>the existence of a third category: \u201csubstantiated concern.\u201d&nbsp;&nbsp;There\u2019s supposed to be a formal rulemaking process, complete with public comment, before a Massachusetts agency does something like that; but hey, they\u2019re the family police \u2013 rules are for other people, right?&nbsp;&nbsp;They just pulled this new category out of their \u2013 uh, imagination.&nbsp;&nbsp;Only after the lawsuit described below, did DCF go through the rulemaking process (which was, of course, a foregone conclusion since they already had the rule).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s what made this new category so dangerous:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DCF unilaterally decided that victims of \u201csubstantiated concern\u201d findings are not entitled to fair hearings.&nbsp;&nbsp;Instead, they can write to DCF itself and ask them to please reconsider.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So-called \u201csubstantiated concern\u201d determinations don\u2019t result in a listing in the central registry \u2013 but they still go into DCF\u2019s internal database.\u00a0\u00a0That means they can still be used, by humans or computers, to ratchet up suspicion if there\u2019s another report, increasing the risk of needless foster care placement.\u00a0\u00a0The new category means DCF can stay in the family\u2019s life for months or more, placing them under constant onerous, stressful surveillance.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new category also imposes limits on whether someone so listed can become a foster parent.&nbsp;&nbsp;That\u2019s what happened to a mother known in court documents as Jane Doe.&nbsp;&nbsp;She sought to appeal the \u201csubstantiated concern\u201d finding and was told that wasn\u2019t allowed.&nbsp;&nbsp;So she used the only appeal mechanism open to her \u2013 writing to DCF \u2013 and lost.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then she sued.&nbsp;&nbsp;And won.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Superior Court Justice Katie Rayburn&nbsp;<a href=\"https:\/\/www.bostonglobe.com\/2023\/07\/02\/metro\/mother-was-accused-neglect-dcf-then-denied-her-hearing-challenge-it\/\">wrote in her ruling:<\/a>&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>[M]ore than half* of the DCF\u2019s initial \u201csupported\u201d determinations were wrong.&nbsp;&nbsp;There is no obvious reason that the DCF\u2019s determinations of \u201csubstantiated concern\u201d would be any more accurate than its \u201csupported\u201d determinations.&nbsp;&nbsp;As such, there is a great risk that DCF will make \u201csubstantiated concern\u201d determinations which would be more likely than not to be overturned on a quasi-judicial appeal proceedings.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In fact, the odds of injustice may be even greater with this category, as&nbsp;<a href=\"https:\/\/masslawyersweekly.com\/2023\/06\/30\/door-to-fair-hearings-opens-wider-for-dcf-involved-parents\/\"><em>a story in Massachusetts Lawyers Weekly<\/em>&nbsp;explained,<\/a>&nbsp;citing Susan Elsen of the Massachusetts Law Reform Institute. MLRI and the firm of Brown, Rudnick represented Jane Doe.&nbsp;&nbsp;From the story:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>By its nature, the \u201csubstantiated concern\u201d finding is designed for cases in which there is a low risk of harm to a child, making it that much more important to provide parents a means to challenge DCF\u2019s initial findings, Elsen says.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>DCF\u2019s intervention is not \u201cbenign,\u201d Elsen notes. \u2026 \u201cOnce DCF intervenes, the family lives in fear that their child will be taken from them.\u201d\u2026<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Elsen expects that families facing \u201csubstantiated concern\u201d determinations may be even more successful in fair hearings, given that it is an even vaguer standard requiring less evidence and thus less likely to withstand a \u201ccompetent, careful administrative review.\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And Elsen raised another vital issue:&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>From the beginning, Elsen says, one concern was that the creation of the \u201csubstantiated concern\u201d category would only perpetuate racial bias in the child welfare system.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Statewide, Black and Latinx families are reported to DCF more than three times as much as white families, according to Elsen, while in the Boston area, the numbers are even starker, with Latinx families and Black families reported at more than six and nine times the rate of white families, respectively.<\/em>&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">DCF is now providing administrative hearings for those who appeal \u201csubstantiated concern\u201d determinations.&nbsp;&nbsp;But what about the thousands of families slapped with this label since 2015?** (There were 7,929 such determinations in 2021 alone.)&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And who is going to stop DCF from running amok like this the next time it comes up with a similarly brilliant idea?&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">*-The \u201cMore than half\u201d statement is based on 2020 figures, when DCF was reversed 54% of the time.&nbsp;<em>The Boston Globe<\/em>&nbsp;reports that in 2022, DCF did better \u2013 they were reversed only 48% of the time.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">** &#8211; News accounts make clear that the category took effect in 2015, though it\u2019s not clear if all of the harm dates back that far.\u00a0\u00a0The\u00a0<em>Globe\u00a0<\/em>story says the designation was \u201crevised\u201d in 2020.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"821\" height=\"1024\" src=\"http:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith-821x1024.jpeg\" alt=\"Selena Ursa Smith\" class=\"wp-image-29103\" srcset=\"https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith-821x1024.jpeg 821w, https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith-240x300.jpeg 240w, https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith-768x958.jpeg 768w, https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith-1231x1536.jpeg 1231w, https:\/\/amicuscuria.com\/wordpress\/wp-content\/uploads\/2023\/07\/Selena-Smith.jpeg 1584w\" sizes=\"auto, (max-width: 821px) 100vw, 821px\" \/><figcaption class=\"wp-element-caption\">MISSING 2.5 years: Selena Ursa Smith, mom under arrest for protecting her children<\/figcaption><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>Court stops Mass. family police from crushing minimal due process rights for families The Massachusetts Department of Children and Families found that their determinations of \u201cchild abuse\u201d and \u201cneglect\u201d were being overturned after a hearing half the time.
