Family Court Judges’ Attempt to Influence Legislation Defeated (for Now)

A couple months ago, I gave the following testimony to the Washington State legislature:

My name is Bandy Lee, and I would like to express my strong opposition to H.B. 2237 and S.B. 5205, which will make the crisis situation in our family courts deadlier…. Giving family courts further legal ammunition could prove catastrophic.

In Washington State, the Superior Court Judges Association (“SCJA”) is proposing significant changes to … the most important statute governing parenting plan decisions in cases involving physical, sexual, and emotional abuse. House Bill 2237 adopts this proposal, and the companion bill, Senate Bill 5205, retains the original version proposed by SCJA that eviscerates the existing statute and case law protections for survivors of domestic violence seeking relief in family court. It does so by creating even more room for judges to remove children from their protective, non-abuser parent, and for the first time in decades, by allowing perpetrators of domestic violence to share decision-making with their victims. It makes it lawful for family court judges to remove children from non-abuser parents with mental health diagnoses such as anxiety or posttraumatic stress disorder (PTSD), which are common consequences of being a victim of violence.

Family Violence Appellate Project,[1] a leader in creating protections in case law for domestic violence survivors in family law, recently published a memo and line-by-line interpretation of the inherent dangers of this abuser-friendly proposal. For the protection of endangered children and their loving parents, and to prevent further family court-related deaths, H.B. 2237 and S.B. 5205 should not pass.

As legislatures are catching onto judicial abuses in the Family Courts, judges are now aggressively lobbying to pass laws that would make their power even more untouchable. Thanks to the heroic efforts of activists, “the Predator Bill” did not pass, against the attorney general, the WA State majority leader, and the Superior Court Judges Association. Unfortunately, like anyone who goes against this 50-billion-dollars-a-year industry that is always looking to expand its racketeering operation, the senators and representatives who opposed the legislation are facing a vicious smear campaign. The sheer aggression with which anyone trying to place limits are targeted, discredited, and attacked gives away the magnitude and degree of criminality that lies behind this “abuse industry.”

Criminal Courts vs. Family Courts

Hidden within the judicial system, few would believe that something presented as a “Court” is not a court of law but one of anti-law, and one that does not counter but commits crimes. Most people imagine something like the criminal courts, which reflect, more or less, our constitutional and democratic protections. However, there are extreme differences:

With all the problems that criminal courts have, usually racism, criminal courts have structured procedure you can hold them to. Violence is a serious offense and treated as such. The defendant is given a defense attorney who does his job of defending the accused, but the prosecutor also plays her role of presenting potentially incriminating evidence, and there is a jury of peers to hear the facts of the case and to serve as an additional check and balance.

Family Courts have an informal process that almost diametrically opposes criminal courts. What largely flourishes in Family Courts is not racism but sexism, which runs so unchecked as to become a massacre of women — and by extension their children — as I have written about. Far from having a structured process, just about “anything goes” in Family Court. Violence, rather than being taken seriously, is treated as nonexistent in a seeming fantasy notion of “ideal family.” Attorneys from both sides hardly have a role outside of facilitating predetermined judgments, and if they veer outside this task — such as truly defend their client — they risk being sanctioned or disbarred. This is because no one goes against the judge, who reigns supreme in her private fiefdom, in which no jury or public is allowed, where everything is kept under tight “seal”, while whistleblowers are persecuted and reporters punished for doing normal reporting.

In criminal courts, expert witnesses such as myself may be hired to do an evaluation of more nuanced areas that can be presented as evidence, which is examined and cross-examined. The better qualified I am, the more likely the court is to admit me for this task. Fact witnesses are also allowed. Defendant are given a trial within a reasonable timeframe if they refuse to settle — not years or decades — and judgments are made on evidence that rise to a standard of “beyond a reasonable doubt.”

In Family Courts, sound evidence is seldom allowed and in many cases blocked, while specious “evidence” that bolsters the judge’s preferred narrative is elevated, including “experts” with questionable qualifications. In Family Court, the better qualified and more independent I am, the less likely the court will admit me as an expert witness, and inconvenient fact witnesses are blocked, also. Instead, hearsay and perjury prevail, as long as the judge likes what he hears, and even the lower burden of proof, “preponderance of the evidence,” is almost never met.

In criminal courts, the judge is more or less a person beholden to impartiality in charge of the trial, who ensures that the process is conducted fairly and who prevents spurious “evidence” from entering into the case. Counter-claims such as “parental alienation” seldom succeed, as prosecutors and judges are well-versed in criminal psychology and in the typical attempts by perpetrators to deflect charges or to “frame” others. And if the process still fails, there are the courtroom observers from the public or the media, and decisions can be appealed.

In Family Courts, the judge is beholden to no impartiality and has often decided in advance which side to favor, typically based on biases for the male gender or the larger purse — and female judges do not deviate from this rule, either, as they had to be “more male than the men” to have gotten to their positions. And pseudo-theories such as “parental alienation,” rejected across scientific communities and in criminal courts, flourish in Family Courts. Also, whereas criminal court cases end when a trial has concluded, Family Court cases persist almost indefinitely, needlessly muddying previously clear-cut cases and complicating already delicate issues, so that an outsider would not be able to decipher the truth — and this seems to be the purpose. Finally, because of the near-unlimited “judicial discretion,” appeals are seldom possible, let alone successful.

Family Courts are not only a travesty of justice, they are places where criminals are made innocent and innocent people are criminalized. They order children to their abuse at over twice the rate of childhood cancers, and child murders by parent might fall by 20 percent, if Family Courts did not get involved — and that is without counting the death rates of mothers, which are newly, astonishingly coming to light.

ADMISSIBILITY OF DOCUMENTS

(a) Certain Documents Admissible. In a civil case, any of the following documents
proposed as exhibits in accordance with section (b) of this rule shall be deemed admissible unless objection is made under section (c) of this rule:
(1) A bill, report made for the purpose of treatment, chart, record of a hospital, doctor,
dentist, registered nurse, licensed practical nurse, physical therapist, psychologist or other healthcare provider, on a letterhead or billhead;
(2) A bill for drugs, medical appliances or other related expenses on a letterhead or
billhead;
(3) A bill for, or an estimate of, property damage on a letterhead or billhead. In the case of
an estimate, the party intending to offer the estimate shall forward a copy to the adverse party
with a statement indicating whether or not the property was repaired, and if it was, whether the estimated repairs were made in full or in part and attach a copy of the receipted bill showing the items of repair and amounts paid;
(4) A weather or traffic signal report, or standard United States government table;
(5) A photograph, x-ray, drawing, map, blueprint or similar documentary evidence;
(6) A document not specifically covered by any of the foregoing provisions but relating to a
material fact and having equivalent circumstantial guaranties of trustworthiness, the admission of which would serve the interests of justice.
(b) Notice. Any party intending to offer a document under this rule must serve on all
parties a notice, no less than 30 days before trial, stating that the documents are being offered
under Evidence Rule 904 and shall be deemed authentic and admissible without testimony or
further identification, unless objection is served within 14 days of the date of notice, pursuant to ER 904(c). The notice shall be accompanied by (1) numbered copies of the documents and (2) an index, which shall be organized by document number and which shall contain a brief
description of the document along with the name, address and telephone number of the
document’s author or maker. The notice shall be filed with the Court. Copies of documents that accompany the notice shall not be filed with the court.
(c) Objection to Authenticity or Admissibility. Within 14 days of notice, any other party
may serve on all parties a written objection to any document offered under section (b),
identifying each document to which objection is made by number and brief description.
(1) If an objection is made to a document on the basis of authentication, and if the court
finds that the objection was made without reasonable basis, the offering party shall be entitled to an award of expenses and reasonable attorney fees incurred as a result of the required proof of authentication as to each such document determined to be authentic and offered as an exhibit at the time of trial.
(2) If an objection is made to a document on the basis of admissibility, the grounds for the
objection shall be specifically set forth, except objection on the grounds of relevancy need not be made until trial. If the court finds that the objection was made without reasonable basis and the document is admitted as an exhibit at trial, the court may award the offering party any expenses incurred and reasonable attorney fees.
(d) Effect of Rule. This rule does not restrict argument or proof relating to the weight to
be accorded the evidence submitted, nor does it restrict the trier of fact’s authority to determine the weight of the evidence after hearing all of the evidence and the arguments of opposing parties.

The following is not intended to be medical advice. It is for informational purposes only, and general consideration. This is the third of a three-part series I have posted in relation to elder care.

As people age, dopamine levels naturally decline. This is a fact of life.

In a nation with aging Baby Boomers, political campaigners often frame voting decisions negatively knowing negative messaging helps to persuade older people. This is very different from how they target younger voters, which has more optimistic messages and focuses on benefits and rewards. As it turns out, the elderly and aged adults are more swayed by negative than positive messaging in study after study. The reasons are more fundamental in nature than you might think.

Dopamine plays a critical role in our perceptions of reward and pleasure. Why is it that aging adults increasingly have less of it? This is partly due to the increased activity of monoamine oxidase B (MAO-B) as people get older. MAO-B degrades dopamine. This promotes falling dopamine levels. Every decade past the age of 45 dopamine levels decline by 13% on average. This decline is directly proportional with the increase in MAO-B.

Most drugs that have been developed in relation to neurotransmitters are for serotonin. Modern medicine continues to struggle with how to respond with effective treatments to a range of conditions and disorders promoted by dopamine dysregulation and decline. Some of these have focused on inhibiting the MAO-B enzyme. Others focus on nutrition, noting that a specific form of vitamin B12 helps protect neurons and prevent a decline in dopamine levels.

Dopamine is important to helping regulate mood, but it does much more than that. It’s critical to our cognitive health, and cognitive decline is known to accompany dopamine decline. It supports memory, retention and more. Dopamine not only maintains our motivation and feelings of pleasure but reduces risk for neurodegenerative illnesses. It isn’t just a neurotransmitter; it is known as the “feel-good hormone”. Low dopamine levels are associated with depression, aka “unhappiness”, dissatisfaction, etcetera. Dopamine is fundamental for movement, body coordination, learning and cognition. Sustaining and maintaining dopamine levels is so fundamental to the body it is associated with prolonged lifespans due to all the critical roles it plays in the body.

It is now known that MAO-B activity is higher in dementia patients than in non-impaired individuals the same age. Some feel this is an indication it has a strong role in neurodegeneration. Why? Increased MAO-B activity results in potentially damaging by-products that form and are known to contribute to diseases like Parkinson’s and Alzheimer’s Disease.

This is why it has become common for doctors to prescribe MAO-B inhibitors like Deprenyl (aka selegiline). People with dopamine deficiency related health issues need to retain more dopamine and stop its degradation promoted by increased MAO-B activity with aging. Once the symptoms surface suggesting the effects of dopamine decline, early treatment, or treatment as soon as possible (as identification and diagnosis allows), is better.

The drug Deprenyl is similar to discoveries made of some plants that naturally inhibit MAO-B enzymes. Phellodendron tree bark as one of the most potent plant-derived MAO-B inhibitors. This is NOT the same as the houseplant Philodendron. The Phellodendron tree is also known as the Amur cork tree. It has been safely used in traditional Chinese medicine for centuries to treat various ailments. Lab experiments using extracts of Phellodendron bark selectively inhibited over 80% of MAO-B activity, which is comparable to the drug Deprenyl. Phellodendron also protects against neuroinflammation, beta-amyloid production, and other changes associated with Alzheimer’s disease, while helping to maintain cognitive function. It has demonstrated anti-inflammatory, antibacterial, antiviral, and antitumor properties.

Elevated MAO-B has known neurotoxic effects.

Those who take MAO-B-inhibiting drugs such as Deprenyl do not need to take Phellodendron. Neither is Phellodendron is not a substitute for physician-prescribed medications. However, plants like it were the inspiration for the modern medicines we have in this category of drugs that have proved useful.

A form of B12, adenosyl-cobalamin, has also been shown to prevent a decline in dopamine levels and protect neurons. Research for this was funded by the Michael J. Fox Foundation.

None of this is to suggest that dopamine decline necessarily equates to poorer decision making. There is little difference between older and younger demographics in studies involving this question. However, the concern is quality of life for those aging and in their elder years, reducing pain and discomfort and extending good health in ways that must incorporate dopamine as a consideration in general health and maintenance, even as other aspects of health are.

The older people get, the more sensitive they are likely to become to sugar and salt. As a consequence, especially over time, this stresses organs, glands and systems of the body and its regulation. The heart and cardiovascular, the brain and nervous system, the gut, and especially the liver and kidneys, take the brunt of this. They get tired and exhausted, too, as we age. Giving them a break can be very meaningful for our health. For many, the first step in that often requires reducing or eliminating sugar, salt, or (ideally) both.

Hyperglycemia (diabetes) and hyperchloremia (high salt; electrolyte imbalance) can contribute to one another and both are hard on the body’s systems, processes and organs. Because of the stress that both induce on the kidneys, other imbalances may occur as well.

Reducing and eliminating sugar and salt has benefits for older adults where health issues begin to surface. First, it relieves stress on the kidneys and liver. Blood pressure goes down. The host of benefits is so great, in fact, it’s difficult not to perceive the “win” and upsides to managing to accomplish that dietary change. People often focus on one or the other, but both are important to achieve the full end benefits.

Vitamin D deficiency is more common the older adults get. This contributes to dopamine drop-offs and deficiency, as well as issues with bones and muscles. Vitamin D is important to bone maintenance in adult bodies. It assists in maintaining the balance of calcium in the blood and bones, among other factors. It plays a role with the nervous system, musculoskeletal system and immune system. Vitamin D must persist enough in the body for it to use calcium and phosphorous to build and maintain bones.

The food you eat, followed by sunlight, are the two best ways to acquire it, with supplements a third option.

People can develop chronic and/or severe Vitamin D deficiency. As a result, calcium and phosphorous absorption in the intestines leads to hypocalcemia. That means low levels of calcium in the blood. A secondary reaction to that by the body is hyperparathyroidism. The parathyroid glands become overactive in an attempt to keep calcium levels in the blood normal. In other words, rather than hyperparathyroidism being a primary diagnosis, it is a secondary diagnosis, with hypocalcemia being the primary diagnosis, and the underlying cause Vitamin D deficiency. Whenever we examine “hyper-” and “hypo-” conditions, understand that the body is an adaptive organism and attempts to compensate in response as it regulates. Therefore, the body’s overproduction or overactivity regarding some functions may reveal other physiological functions that are underperforming, upon further investigation. Identifying these contributes to generating more complete information that delivers better diagnoses and treatment.

Symptoms of hypocalcemia and hyperparathyroidism include muscle weakness, cramps, fatigue and even depression. It’s important to remember that mental health isn’t a complete diagnosis in its own right but is accompanied by underlying comorbid physical factors promoting mental health issues. For instance, depression is a common effect of stroke or cardiovascular conditions leading up to that. It is scientifically understood that treating mental health is insufficient without identifying and treating the underlying physical causes promoting it.

Secondary hyperparathyroidism takes calcium from the bones to maintain calcium levels in the blood. This accelerates bone demineralization. Older adult bodies heal and repair themselves at slower rates than their younger counterparts, so this condition is more profound in older adults since bone can breakdown faster than it can reform. Osteomalacia (soft bones) can result, along with osteoporosis and other conditions. This leaves older adults more vulnerable to bone breaks and fractures. Deformities in joints and incorrect growth patterns in bones that manifest as bowing or bent bones can emerge. This comes with bone pain and muscle weakness. Depression is also one of the symptoms.

Sometimes people don’t properly absorb or use Vitamin D. This can be the result of certain medical conditions or medications. Conditions of the kidney and stress on them are particularly noted for reducing the amount of certain enzymes the body needs to convert Vitamin D to a form it can use. What are these enzymes? Hepatic enzyme 25–hydroxylase from your liver and 1-alpha-hydroxylase from your kidneys. Insufficiencies in either of these enzymes leads to deficiencies of active Vitamin D circulating in the body.

A checklist of medications that can lower Vitamin D levels includes:
[] Laxatives
[] Steroids (example: prednisone)
[] Cholesterol lowering drugs (example: cholestyramine and colestipol)
[] Seizure preventing drugs (example: phenobarbital and phenytoin)
[] Rifampin (a tuberculosis drug)
[] Orlistat (a weight-loss drug)

Healthcare providers don’t usually order routine checks of Vitamin D levels.

Certain medical conditions or risk factors for vitamin D deficiency (or symptoms of it) warrant a Vitamin D level check. A provider must order it.

There are two types of tests. The most common is the 25-hydroxyvitamin D, known as 25(OH)D.

The goal of treatment and prevention is the same. Reach and maintain adequate levels of Vitamin D in the body.

Vitamin D supplements come in different forms, just like other vitamins. Some are more easily digested and assimilated than others. Sometimes a broken-down version of a vitamin is easier for the body to absorb and utilize where it is having issues breaking down or metabolizing it. This saves the body steps and bypasses problem points to resume or continue delivering the body what it requires nutritionally in metabolic processes for its greater tasks and functions.

The two forms of Vitamin D are D2 and D3. D2 comes from plants, known as ergocalciferol. D3 comes from animals, known as cholecalciferol. D2 is available in vegan form, while D3 is the commonly available form found in most vitamin supplements. Here is the difference between them. Other than acquiring a vegan multivitamin source with D2, it is usually given by prescription from doctors. While Vitamin D3 is considered more bioavailable and is sustained longer in the bloodstream and body, Vitamin D2 is considered more appropriate as indicated to treat calcium disorders and parathyroid disorders. It is also the preferred form for patients with chronic kidney disease or stressed kidneys. The vitamin D prescription people get from a doctor is typically for 50,000 units of vitamin D2.

Health issues and problems are complicated. Some of the remedies, if caught early enough, however, can be simple and significantly reduce these and extend health. We often treat the symptoms in modern medicine. Diagnostics are expensive. We forget the basics and the underlying good measures we can take to help ourselves. Medicines help, but they aren’t necessarily cures. I hope the simple practices described herein for reducing salt, sugar and understanding the underlying mechanisms at work prove useful or helpful if you are facing these kinds of questions and health issues.

-Provide reassurance and support
-Encourage exercise, support group
-Maintain a normal routine and avoid unnecessary changes
-Older adults may be triggered by a previous traumatic event, especially after feeling helpless because of a new disability
-Recognize and acknowledge that older loved one’s fears and worries are normal AND real; ACCEPT, don’t minimize

*SLOW down, SLOW the pace, PAUSE, take a DEEP breath until heart rate decelerates, work towards maintaining and returning to baseline (helps with brain training, recovery & restoration, and mitigation of effects of declining heart health, which promotes and amplifies stress and dysregulation (impulse control…certain functions outpace others))
*LISTEN

Always go back to basics…air, hydration, food (nutrition), rest, some exercise (light & easy), environment
Reduce stress
Short tasks, small steps, shorter durations of time with more pauses and reflection (time to think)
*Avoid long tasks, long conversations, longer series of steps

Breathe. Focus on your breath and let other thoughts fade away. Don’t judge yourself for having them, but don’t pursue them; try to let them go.

Practice self-compassion and encourage self-compassion

Give yourself credit for trying and encourage that

Practice positive self-talk (even for a minute or two) until you reach a point where you notice it’s starting to help you and you feel less stressed

Keep at it. It isn’t like riding a bike. You must do it regularly for it to help you.

Practice mindfulness. It helps you not only recognize your emotions and stay attuned to it, but with also what’s going on with your body without judging any of it as good or bad.

Notice if your body is tense or if your mind keeps trying to go back to a particular unpleasant topic, but don’t get down on yourself — just recognize what’s going on as a way of gathering information about yourself.

Friends are important. Choose friends carefully, who can be rea friends of support.

Consider joining a meditation group.

Light and easy exercise that doesn’t stress you is helpful. Maybe it is light yoga, using the back of a chair as support, lifting the leg and flexing the foot while practicing balance and shifting posture. (chair yoga)
Small walks
Swimming and water aerobics
Music and dancing, light movement with music
Bodyweight exercises

Avoid sugar and salt, but hydrate well
Proper nutrition is critical for your mental and physical health. Your food fuels your brain, so getting the right balance of protein, healthy fats, and carbohydrates will help you
Remember moderation and balance your diet with variety in place of overindulging on one thing

Being goal oriented, mission oriented, focused on accomplishing the task and completing it (also amplifies tendency for “tunnel vision” and forgetting to breath, pause, which is important to de-stressing, managing stress as we go…)
*What is great about being focused and goal oriented can also be an Achilles heel as we age…which is why “moderation” and “good habit” and continuing to encourage and develop the skill of checking in with one’s self and reflecting as we go is useful and helpful, something we must all WORK at as we age and cope with health issues and what continues with life

Technology is inherently stressful, since it always comes with demanding time and many series of steps with troubleshooting and doesn’t work reliably…coupled with the fact that our society and lives are more dependent than ever on it, a stress for older adults and those with health problems to interface with the services and continue to engage in community and their needs utilizing it as they need to

Common sources of stress for our older loved ones:
-Stress from being dependent on others
-Cost of living expenses or medical expenses
-Bereavement
-Social isolation and loneliness
-Fear of falling or other medical emergencies

Personal autonomy and maintaining that, with independence, is important to each older person

Social interaction is important to our older loved ones.
Worry can compete with positive interactions. Remember that we are seeking positive relations from each other, so remember to “stop and smell the roses” and let the worry fall to th wayside. Let that positivity grow. Worry is like a weed that eats at our garden. Cultivate and nurture. Worry comes with stress and feeds the same. Give worry its due, but let the flowers bloom, too.

Two U.S. Senators have written to Elon Musk, Tesla’s top executive, calling on him to “swiftly” recall any steering and suspension parts that pose a safety risk.

The letter cites “an alarming” Reuters investigation published on December 20 that exposed how Tesla has blamed drivers for frequent failures of components it has long known were defective.

“We write with extreme concern following recent reporting about Tesla’s knowledge of safety flaws in its vehicles and concealment of the causes of these flaws from the National Highway Traffic Safety Administration,” states the letter, which is signed by Senators Richard Blumenthal, of Connecticut, and Edward J. Markey, of Massachusetts.

The senators call on Musk to correct “apparent false and misleading representations” made to the safety agency.

The Reuters report found that Tesla told NHTSA and customers that the frequent failures of defective parts in its electric vehicles were caused by driver “abuse,” such as hitting a curb. In 2020, Tesla gave that explanation in a letter to the safety agency explaining why it would not recall a suspension part called the aft link in the United States, despite having just recalled it in China.

Tesla documents reviewed by Reuters show the automaker’s engineers for years tracked frequent failures of aft links and other suspension, steering and axle parts, often on relatively new cars. The company instructed its service managers to tell customers that the parts were not faulty as it struggled to contain soaring warranty costs, the records reviewed by Reuters show.

“We are disturbed that you would blame your customers for these failures,” stated the letter from Blumenthal and Markey, both Democrats. “It is unacceptable that Tesla would not only attempt to shift the responsibility for the substandard quality of its vehicles to the people purchasing them, but also make that same flawed argument to NHTSA.”

Musk and Tesla did not immediately respond to requests for comment on the senators’ letter. Neither answered detailed questions from Reuters for the Dec. 20 investigation.

Sweden’s Transport Agency said on Friday that it’s investigating suspension failures in Tesla cars. The inquiry is similar to one being carried out in neighboring Norway, where the Norwegian Public Roads Administration said last week it was looking into consumer complaints about lower rear control arms breaking on its Model S and X vehicles.

Markey and Blumenthal have previously raised concerns about Tesla’s marketing practices and the safety of its automated driving technology.

In April, the senators wrote to Musk questioning him about another Reuters investigation, which reported that groups of Tesla employees had circulated, via an internal messaging system, private and sometimes highly invasive recordings from customers’ car cameras.
