W/All due respect to Mr. Hicks, this posting is a study in how to lose your case as a pro se Family Court litigant–not that any parent can expect the tiniest measure of justice or fairness in such a barbaric lawless incompetent adversarial forum.
Mr. Hicks marriage lasted about 18 years after tying the knot w/his bride, Roth, in Illinois before ultimately moving to the PNW where their son was born. They both worked and were successful enough to have purchased 2 homes and Hicks makes reference to investments of the order of 100’s of thousands of dollars beyond the 2 homes, one in Raineer and one in Yelm, the less favored of the two. Nevertheless, Hicks whines and pleads poverty frequently in his voluminous repetitive incoherent pleadings before the court.
Roth, the far more articulate of the two, alleges her husband is violent, suicidal, abusive, unstable, and threatened to kill her after getting physical w/her in the presence of their young child. She also alleges the father threatened to kill the child, offering cell phone text messages as proof. Roth offers little independent corroboration while Hicks argues she is lying and the evidence she presents is fraudulent. Both parties act like control freaks intent on micromanaging the other.
Hicks spends a lot of time complaining of how Roth’s legal filings have ruined and unfairly/falsely maligned him–repeating himself over and over adnauseam. But, the record does show more than one woman has sued Hicks for domestic violence. Moreover, Hicks doesn’t know when to shut up. He admits threatening to kill his wife. He denies he would carry out the threat which is no defense against an allegation of assault and domestic abuse. He enters suicidal ideation in his declarations and refers to his wife in the present rather than the past tense even after the decree of dissolution has been granted and entered into the record. He fawns and grovels before the court.
Schaller nixes both parties’ effort to have the court micromanage the other. Once Roth hires Redford-Hall for representation, things get worse as Roth’s attorney habitually uses hearsay and argument as testimony–a rules violation. But it goes unchallenged by Hicks who is clearly out of his depth as a pro se litigant. He files a number of post judgment declarations and incoherent motions improperly without the wit to even note them up properly for the court calendar to be heard and serve notice of issue/hearing.
Hicks is ill equipped intellectually, educationally, or emotionally to represent himself. He mentions approaching nearly a dozen law firms who refuse to represent him, for good reason I concluded after speaking w/him briefly by phone. Hicks would not be a difficult client, he would be an impossible one. He complains he was given no chance to reconcile w/Roth or his son, yet failed to show up for mediation and remains noncompliant w/the Court’s orders arising out of the DVPO.
Some people are their own worst enemy. Mr. Hicks bridles at the lack of privacy he encounters as a result of said lawsuit, even attempting to dissuade this reporter from publishing the public record–saying he wanted to minimize how public it was and seek a legal remedy at odds w/the 6th Amendment mandate requiring transparency at every step of legal proceedings such as these.
When it comes to 1st Amendment prerogatives, this reporter takes no prisoners and has no friends. He is fully committed to retaining the PUBLIC in ‘public records’.
